9th Circuit vacates rule reducing Medicare payments to some hospitals

A federal appeals court has struck down a U.S. Department of Health and Human Services rule that could result in lower Medicare payments to certain hospitals that treat a large number of low-income patients.

The 9th U.S. Circuit Court of Appeals on Monday held the 2005 rule violated the Medicare Act’s “unambiguous” text and contradicted an earlier ruling regarding how the payments should be calculated.
