PharMerica escapes case claiming kickbacks to nursing homes

By Brendan Pierson A federal judge has dismissed a whistleblower lawsuit accusing pharmacy services giant PharMerica Corp of paying kickbacks to nursing homes in exchange for prescription drug referrals, finding the whistleblower’s complaint rested entirely on public documents.

U.S. District Judge Noel Hillman in Camden, New Jersey ruled Monday that the lawsuit was barred by the federal False Claims Act’s public disclosure bar, which precludes whistleblower cases based on public information.
