Plaintiffs, Monsanto ask MDL judge to weigh evidence for trial bifurcation

Plaintiffs in a multidistrict litigation over whether Bayer AG’s glyphosate-based weedkiller Roundup causes cancer have submitted three pieces of evidence to the judge to categorize as part of his plan to split the trial into causation and liability phases.

The evidence plaintiffs submitted to U.S. District Judge Vince Chhabria in San Francisco included a tumor in a single mouse, Bayer unit Monsanto’s alleged attempts to influence the National Cancer Institute and a scientist’s evaluation of glyphosate studies.
