U.S. appeals court deals tobacco companies setback in Florida

By Nate Raymond A U.S. appeals court has ruled individual smokers pursuing lawsuits against tobacco companies in Florida can rely on a class action jury’s findings that the companies were negligent and sold defective cigarettes.

In a 7-3 decision, the full court of the 11th U.S. Circuit Court of Appeals on Thursday rejected an earlier three-judge Circuit panel’s holding that had said the jury’s findings of strict liability and negligence were preempted by federal law.
