NLRB rejects general counsel's bid for default judgment against ConAgra

ConAgra Foods Inc avoided a default judgment in a case involving alleged unfair labor practices because it did not get prior notice that it may have breached the terms of a settlement agreement it had with a union at a Slim Jim’s manufacturing plant in Ohio, the National Labor Relations Board ruled.

Without advance notice from the NLRB’s general counsel that a rule ConAgra had restricting discussions about unions in the workplace would violate the settlement deal, granting the office’s motion for a default judgment would deny the company’s right to procedural due process, the board said on Thursday.
